1. ACCEPTABLE USE
I understand that I must use Popup systems in a responsible way, to ensure that there is no risk to my safety or to the safety and security of the systems, devices and other users. This Policy will also apply to any personal devices that may connect with Popup Services.
2. USE OF THE SERVICE
Popup runs on trust, and it’s critical that we protect the privacy of our customers. We take this responsibility seriously, and we won’t tolerate behavior or content that puts the privacy or security of another user at risk.You agree and acknowledge that you will not:
a) Always respect the privacy of others

You agree and acknowledge that you will not:
i) Share your profile with strangers;
ii) Share information about another user without their permission;
iii) Use private information of Popup without our permission.
b) Deceiving And Impersonating Others
i) Don’t do anything that's false, fraudulent, inaccurate or deceiving.
ii) Don’t impersonate another person, company or entity.
iii) Don’t engage in misleading or unethical marketing or advertising.
c) Abusing And Disrupting The Services
i) Don’t probe, scan or test the vulnerability of any system or network.
ii) Don’t breach or otherwise bypass any security or authentication measures.
iii) Don’t access, tamper with or use non-public areas or parts of the services, or shared areas of the services you haven't been invited to access.
iv) Don’t interfere with or disrupt any user, host or network (whether it’s Popup’s or someone else’s), for example by distributing malware or overloading, flooding or mail-bombing any part of the Services.
v) Don’t take apart, decompile or reverse engineer any part of the services in an effort to access things such as source code or algorithms.
vi) Don’t access, search or create accounts for the services by any means other than our publicly supported interfaces (for example, scraping, spidering or crawling).
vii) Don’t take action that imposes an unreasonable load on our infrastructure or our third party providers. We reserve the right to determine what’s reasonable.
viii) Don’t provide your password to any other person, use any other person’s username and password, or otherwise manage the services through shared credentials.
x) Don’t avoid, bypass, remove, deactivate, impair or otherwise circumvent any technological or other measures (including watermarks) used by Popup or any other party (including another user) intended to protect the services.
xi) Don’t remove any copyright or other proprietary notices from the services.
d) Intolerance and Discrimination
Popup respects diversity in race, ethnicity, color, religion, gender identity, sexual orientation, ability, national origin, and other groups. Content should not demean, marginalize, use hateful language against, or belittle other users or groups.
e) Terrorism and Violence
Popup aims to prevent potential online and offline harm that may be related to terrorism and violence. We prohibit content or conduct that supports, glorifies or promotes any terrorist or extremist organization and its actions, including:
i) Statements of intent to commit violence;
ii) Statements advocating violence;
iii) Aspirational or conditional statements to commit violence;
iv) Content about other target(s) apart from private individuals, minor public figures, high-risk persons or high-risk groups;
Calls for action of violence;
v) Depictions of or support for terrorist or extremist attacks or terrorist actors;
vi) Depictions of or support for the leaders of terrorist organizations;
vii) Depictions of the slogans, images, flags, or icons of terrorist organizations;
viii) Fundraising for terrorist or extremist organizations, people, or groups.
f) Spamming And Phishing
i) Don’t use our services to send spam, emails that violate CAN-SPAM or other laws, emails to people who have not explicitly consented (where such consent is required) or other unsolicited communications (bulk or otherwise), promotions or advertisements. Note, we reserve the right to determine what constitutes spam.
ii) Don’t send altered, deceptive or false source-identifying information (including any misleading or incorrect names, email addresses, subject lines), including without limitation phishing or spoofing.
g) Stealing
i) Don’t use unauthorized credit cards, debit cards or other unauthorized payment devices on the Services.
ii) Don’t promote or advertise products or services other than your own without appropriate authorization.
iii) Don’t sell the services unless specifically authorized to do so, or publish or use the services on any network or system other than those provided by Popup unless previously authorized by Popup.
h) Prohibition
Popup prohibits content designed to deceive others or duplicate and disruptive sharing anywhere. This includes:
i) Phishing (it has been designed to impersonate a real person or organization);
ii) Vishing (is similar to phishing, except it happens over the phone);
iii) Baiting (similar to phishing, involves offering something enticing in exchange for your login information or private data);
iv) Quid pro quo (involves a hacker requesting critical data or login credentials in exchange for a service);
v) Clickbait-type advertisements;Repetitive, large-volume messaging;Creating experiences solely to direct users off Popup.
i) Cheating and Exploits
Cheating and Exploits in this Acceptable Use Policy mean any trickery or subversion of the rules or mechanics of Popup system to gain an unfair advantage over other users, generally with the use of third party software. We don’t permit users to deploy any methods of cheating, including:
i) Using exploits to gain an unfair advantage anywhere on the platform;
ii) Sharing exploits with others or encouraging others to cheat the system.
j) Enforcement
If you violate this Acceptable Use Privacy, we may stop providing services to you or we may close your Popup account. We may also block delivery of a communication to or from the services in an effort to enforce these terms.
Instances of abusive, harassing, or otherwise unacceptable behavior may be reported by contacting us at legal@popup.store All complaints will be reviewed and investigated and will result in a response that is deemed necessary and appropriate to the circumstances. We are obligated to maintain confidentiality with regard to the reporter of an incident.
3. SECURITY
a) Security Operation
Data security is our top priority. We take myriad security measures to ensure that our customer’s data is secure and safe. We have also implemented security measures to prevent fraud and flag abuse of our software. Continuous improvements are carried out by conducting security architecture reviews. We contract external security consultants who perform manual penetration tests of new features before each release. These tests are always conducted in a separate environment with no actual customer data present.
b) Account Security
You are responsible for keeping the password that you use to access the services secure and you agree not to provide your password to any third party. You are responsible for all activity using your account, whether authorized by you. Accordingly, you should notify Popup immediately of any unauthorized use of your account. You acknowledge that if you wish to protect Your Data when you are transmitting it to Popup. It is your responsibility to use a secure connection to do so.
13.3. Exclusions
The obligations of this Section 13 will not apply to Confidential Information if such information: (a) is publicly available prior to or at the time of disclosure, or later becomes publicly available through no act of the Receiving Party; or (b) was, prior to disclosure hereunder, rightfully known to the Receiving Party (other than in connection with this Agreement) without confidentiality restriction.
